The following booking disclosures are valid for all Beyond The Classroom or “BTC” tours.  

By signing the Beyond The Classroom participant application and with partial or full payment of required deposit for reservations for any Beyond The Classroom (BTC) tour or activity shall constitute an understanding and consent to all provisions of the List of Disclosure and Conditions, Terms, Policies or other information contained in this document, brochure, or other documents related to any Beyond The Classroom tour or activity.

1. I understand and agree that this tour booking agreement and the booking conditions of Beyond The Classroom constitute the entire agreement between Beyond The Classroom and me with reference to the subject matter herein, and I do not rely upon any promises or agreements not herein, including, but not limited to, any oral statements made to me by agents or employees of Beyond The Classroom, or by the teacher/group leader assigned to the tour. 
2. I understand and agree that this tour booking agreement shall be governed in all respects, and performance hereunder shall be judged by the laws of the state of Colorado.
3. I understand and agree that my tour begins with the flight departure from the Beyond The Classroom designated airport and ends upon the completion of the flight back to the Beyond The Classroom designated airport.  I also understand and agree that Beyond The Classroom assumes no liability or responsibility for missed flight connections or any other delays that might occur. 
4. I understand and agree that the air carrier’s liability for lost or damaged luggage, or for the death or injury to person, is limited.
5. I understand and agree that Beyond The Classroom is the principal tour operator.  Beyond The Classroom, its agents, employees and volunteers shall not be responsible or liable in respect of either person or property for any loss, damage, injury, accident, illness, death, delay, or irregularity however occasioned , sustained, or suffered in or during any packaged journey, trip or in carrying out any arrangements booked by or through Beyond The Classroom or from the actions or failure of actions on the part of the airline carrier, transportation company, hotel, or any other sub-contractor or other individual service provider.  All rates are quoted in US dollars, and are based upon tariffs and exchange rates in effect.  All rates quoted are subject to change without notice.
6. I understand and agree that Beyond The Classroom shall have no liability or responsibility for me when I am absent from Beyond The Classroom supervised activities or for any non-Beyond The Classroom supervised activities.  For example, visits to friends and/or family, or during optional travel ahead or stay behind periods which do not include the services of a Beyond The Classroom representative.
7. I understand and agree that no person not enrolled on the Beyond The Classroom student tour is allowed to join the tour and/or any Beyond The Classroom activity at any time.  I understand and agree that I may not leave the Beyond The Classroom student tour or Beyond The Classroom activity, at any time on my own, or to join up with friends or relatives. 
8. I understand and agree that by signing up for a Beyond The Classroom tour or activity, I have made the choice to travel with the teacher/group leader organizing my group, and I understand that this choice is not the responsibility of Beyond The Classroom.  I understand that a group leader/teacher must accompany me on tour.  If my teacher/group leader cancels for any reason, Beyond The Classroom will ask him/her to assign a new group leader for the tour.  I understand and agree that if I cancel my tour at this point, and choose not to travel with the replacement teacher/group leader, I will be treated as a standard cancellation. 
9. I understand and agree that all teacher/group leaders are subject to background checks and required to be licensed, certified, or state approved to work with minors.  No person, not designated by Beyond The Classroom, as a teacher/group leader for a designated tour or activity may participate despite payment in part or whole for their own expenses.  All teacher/group leaders must be current in First Aid/CPR certification at the time of travel.
10. I understand and agree that all teachers/group leaders for Beyond The Classroom are required to sign a contract with Beyond The Classroom prior to traveling.  These individuals are subject to the policies, laws and rules of the Board of Education and the government of the state where in they are employed.  It is a priority of Beyond The Classroom to obtain teachers/group leaders that are licensed or certified to educate.  Background checks will be conducted of all representatives and teacher/group leaders prior to tour involvement.  The policy of Beyond The Classroom is to offer at least a ratio of 10 persons per teacher/group leader.  In addition to the teacher/group leader, one or more Beyond The Classroom representatives will act as tour director, and shall govern the conduct of the tour.  The safety and well being of the tour participants is the primary concern of Beyond The Classroom and shall govern the conduct of the tour. 
11. I agree to release, indemnify and hold harmless Beyond The Classroom tours and its affiliates, and my school, my school board and group leader, (the “Released Parties”) from, and agree not to sue the “Released Parties” for, any and all claims, demands, actions, lawsuits, settlements, judgments, damages, losses, costs, and expenses of any nature whatsoever, on account of or arising out of any and all personal injury, death, bodily injury, mental anguish, emotional distress, physical, property or other damage that I may suffer from any cause whatsoever related in any way to my participation in any Beyond The Classroom sponsored tour or activity.  I further agree to release, indemnify and hold harmless the “Released Parties” from any and all acts of God, war (whether declared or undeclared), terrorist activities, instability in a destination country, incidents of violence, public health issues or quarantine, substantial currency fluctuations, strikes, government restrictions, fire, or severe weather conditions which make it unsafe, impossible or unreasonable commercially in the opinion of the Beyond The Classroom representative to conduct the tour, or the acts of omissions of any other agents over which the “Released Parties” have no direct or indirect control, including without limitation, airlines, railways, bus companies, guides, or sub-contracted agents or tour operators.
12.  I understand and agree that in the event of a change in the itinerary necessitated by factors or conditions beyond the control of Beyond The Classroom or the “Released Parties”, no refund or credit will be allowed provided that Beyond The Classroom provides accommodations and services of comparable quality and standards set forth in the brochure and other tour documents.  Any such change shall not modify the cancellation provisions in the brochure or other tour documents.  No refund or credit will be allowed in whole or part, for any services or other features included in the package, for unused air transportation, land transportation, hotel accommodations, or scheduled tour activities should any such services not be utilized by any tour participants.
13. I understand and agree that Beyond The Classroom reserves the right to substitute all forms of transportation, tour activities, hotels, ground operators of similar or better quality without penalty or prior notice, should, in the opinion of a Beyond The Classroom representative, circumstances so demand.
14. I understand and agree that no person, other than an authorized Beyond The Classroom representative, by a document in writing, is authorized to vary, add or waive any term or condition in the brochure or other tour documents including any term or condition set forth in the preceding provisions.  All tours are subject to the provisions and conditions of this document as well as specific documents signed and agreed to by the students’ parents/guardians or adult (over 18 years old) tour participant for any particular tour or activity. 
15. I understand and agree that Beyond The Classroom reserves the right to decline, accept, reject, or to retain any person as a participant of a tour should such person’s general deportment impede the operation of the tour, or the rights, welfare, or enjoyment of the other tour participants, teacher/group leader, and or Beyond The Classroom representative(s).  Beyond The Classroom reserves the right to cancel a tour participant’s reservation at any time prior to the tour departure for any reason, and Beyond The Classroom’s sole liability shall be to refund the participant’s deposit or any payments made to Beyond The Classroom by the tour participant.

16. I understand and agree that I will abide by Beyond The Classroom’s regulations and the direction of my Beyond The Classroom representative and/or teacher/group leader during my tour.  Failure to do so, may result in BTC removing me from the tour or activity immediately at the sole expense of my own or my parent/guardian.  I also understand and agree that to disobey such rules or directions is to waive the right to a refund in part or whole.
17. I agree to abide by all local laws when on tour, including those concerning drugs and alcohol.  I understand that if I abuse or disobey such laws, even unintentionally, I waive my right to a refund of any part or whole, and Beyond The Classroom may remove me from the tour or activity immediately at the sole expense of my own or my parent/guardian.  I also understand and agree that should local authorities be involved, I will be subject to the laws of the country I am visiting.
18. I understand that it is my responsibility, and not the responsibility of Beyond The Classroom, to secure the necessary travel documents including photo id, passport, and visa.  Failure to do so, does not constitute grounds for a refund except according to the standard cancellation policies.  If you are on the “No Fly List” of the TSA, it is your responsibility to obtain boarding clearance prior to departure.
19. I understand and agree that Beyond The Classroom tours and activities are designed with the age group of the participant in mind.  Pace, educational content, accommodations, and other aspects of the tour reflect this.  It is the responsibility of the tour participant to select a tour that is appropriate for their abilities and interests.  Trip participants are held responsible for being in sufficient good health to undertake the tour. 
20. I understand and agree that if I should become ill or incapacitated while on tour, Beyond The Classroom and its representatives, or teacher/group leader may take any action they deem necessary for my safety and well-being, including securing medical treatment, and/or transporting me home at my own or parent/guardian expense.  I understand that tour conditions may not permit a tour participant being left at the hotel to recuperate.   
21. I understand and agree that I will be required to pay for all phone calls and any personal incidentals while on tour including any damage I cause to hotel rooms, buses, or other property.
22. I agree, understand and hereby give permission for any photograph or film likeness of me or comment while on tour, to be used in any publication or promotional literature for Beyond The Classroom or its parent corporation for which it is a registered trademark as a “doing business as” entity.
23. I understand and agree that anyone participating while on tour in an equestrian related activity can suffer bodily injuries or death.  Horses are unpredictable by nature and are powerful and potentially dangerous animals.  Beyond The Classroom requires the wearing of a certified riding helmet in good condition at all times while participating in an equestrian related activity. 
24. I understand and agree that the contractors and vendors operating any tour reserve the right to reject any riding or equestrian related activity participant for any reason, including, but not limited to, riding skill level, behavior, or weight.
25. If any participant on a riding tour or equestrian related activity is a minor, his/her parent/guardian, must assume all responsibility and liability, and agree to indemnify and hold harmless Beyond The Classroom, or its corporate parent for which it is a registered trademark as a “doing business as” entity, against any claims which may arise.  I must also complete and sign the required equestrian application supplement and any release paperwork that may be required by sub-contractors.
